Dear Sirs:

Yesterday, while my car was stationary in a service driveway, it was struck by a commercial delivery truck. We stepped out and exchanged information: I took down his name, license plate, insurance, boss' contact info, etc.; he asked for my name, phone number, and license plate. After talking with him and his boss we agreed that he would stay and complete the police report while I attended to a prior appointment. He returned the pen I'd lent him, we shook hands, and I left the scene.

Today, I was called by the Duke PD to inform me that I had been charged with hit-and-run because when the officer arrived to create the report he could not fill in my insurance info. I think this is patently ridiculous: (1) before leaving I gave the driver ample time to record this info (2) we agreed there was no need since he was at fault (3) when the cop arrived, he could have used the cell phone I had given to contact me then rather than deliberatly wait to issue a citation.

I appreciate any advice you can offer. Since having such a crime on my record would be disastrous, I plan to plead innocent, and may require legal representation. Thank you.
